Board of Directors Election

November 1, 2017

This year, two positions are available for those wanting to serve on the Board of Directors. A Call for Candidates, was mailed on September 30, 2017. In addition, to be considered the enclosed "Declaration of Candidacy" should have been completed and sent to Trisha Garite at Associa-PCM prior to the deadline, October 16, 2017.

Each of these positions are for a two-year term and the selection process will take place on November 21, 2017. Furthermore, any questions or concerns should be directed via email to trisha.garite@associa.us, or telephone at the following: (800) 369-7260.

This is a great opportunity to get involved at the Lake Forest Shores community, so make sure to complete those ballots, follow the rules and submit your votes by the deadline, November 21, 2017.

Currently, there are two candidates running for the HOA positions; Sima Lopez (Incumbent) and Gavin Shu. Everyone should have received an "Irrevocable Secret Ballot" in the mail with voting instructions: Each unit/lot may cast a total of two (2) votes. You may cast two (2) votes for one candidate or split your votes between candidates, so one vote per candidate. The votes will be counted and tabulated on November 21, 2017 and the anouncement of the results shall be recorded in the minutes of the next board meeting and made available for members of the association (the owners) to review within fifteen (15) days of the election date.

If you are interested, but did not submit your "Declaration of Candidacy" on time, you can fill in your name in the blank lines for write-in candidacy on the ballot, but you may have to campaign in order to get sufficient votes by having your friends & neighbors handwrite your name on their ballot.

Moreover, any candidate or other member of the Association may witness the counting and tabulation of the votes. (Cal. Civil Code ยง1363.03)

Lastly, what is "IRS Revenue Ruling 70-604"? On the ballot, you are provided with three (3) choices: "For", "Against" & "Abstain". The purpose of Revenue Ruling 70-604 is to avoid taxation on its excess membership income by either refunding it to the members (community homeowners) or roll it over to the next year. This allows the Association to file form 1120 (rather than form 1120-H) for its Federal taxes. I'm not a CPA, but from my understanding, the form allows the Association to pay tax at 15% on the first $50,000 of taxable income rather than 30%; therefore, make your vote count.
